Background States and families are facing growing challenges provide adequate care for older persons. Smart home health technologies (SHHTs) in the forms of sensor or robotic devices have been discussed as technical solutions for caregiving. Ethical and social concerns are raised with the use of such technologies for caregiving purposes, a particularly prominent one being privacy. This paper contributes to the literature by distinguishing privacy concerns into both the type of technologies and conceptual dimensions.Methods Data for this paper stem from (...) sixty semi-structured interviews with older persons, informal, and formal caregivers living in the German-speaking regions of Switzerland. All information related to privacy, that were initially inductively coded, were thematically sorted into four dimensions of privacy (physical, psychological, social, and informational) and by the type of technologies studied.Results Participants were especially concerned about privacy intrusions from smart wearables and ambient sensors than robotic technologies, which may be due to the relative lack of familiarity with the latter. Informational privacy was evident in the context of data collection capacities and potential for misuses of data. The installation and implementation of both visual and ambient sensors induced discomfort to their senses of physical space. Alerts of smart wearables and obtrusive sightings of SHHTs garnered worries related to stigmatization and manipulation, indicating intrusions into end-users’ psychological privacy. Little discussions of social dimensions of privacy were evident in the data, even toward robotic technologies for their functions to promote social interactions for older persons.Conclusions This paper is one of the first that use the stratification approach on empirical data to highlight the multi-faceted privacy concerns when technologies may be implemented in elder care. Our paper could thus supports potential end-users in deciding which technologies to use and how to balance different privacy concerns against other values that they may hold important. (shrink)

The concept of organizational stigma has received significant attention in recent years. The theoretical literature suggests that for a stigma to emerge over a category of organizations, a “critical mass” of actors sharing the same beliefs should be reached. Scholars have yet to empirically examine the techniques used to diffuse this negative judgment. This study is aimed at bridging this gap by investigating Goffman’s notion of “stigma-theory”: how do stigmatizing actors rationalize and emotionalize their beliefs to convince their audience? We (...) answer this question by studying the stigma over the finance industry since 2007. After the subprime crisis, a succession of events put the industry under greater scrutiny, and the behaviors and values observed within this field began to be publicly questioned. As an empirical strategy, we collected opinion articles and editorials that specifically targeted the finance industry. Building on rhetorical analysis and other mixed methods of media content analysis, we explain how the stigmatizing rhetoric targets the origins of deviant organizational behaviors in the finance industry, that is, the shareholder value maximization logic. We bridge the gap between rhetorical strategies applied to discredit organizations and ones used to delegitimize institutional logics by drawing a parallel between these two literatures. Taking an abductive approach, we argue that institutional contradiction between field and societal-level logics is sufficient, but not necessary to generate organizational stigma. (shrink)

“Women and the Law in Irigarayan Theory” by Gail Schwab is a reading of French feminist philosopher Luce Irigaray's writings on law together with texts of American feminist jurisprudence. The first part of the article summarizes many of the conflicts surrounding the concept of equality in American feminist legal thought and attempts to move beyond them with the Irigarayan principle of equivalence or equivalent rights. The second part of the article deals more generally with the symbolic changes that will (...) be necessary in order to change the law, and with the cultural evolution that changes in the law can bring about, and more specifically with two areas of Irigarayan legal theory that are central to cultural change and evolution: the concept of female identity or virginity, and the relationship to the mother. In the conclusion, a new utopian vision of what law might be‐the cultural mediation for an evolved intersubjectivity‐is developed through Irigaray's most recent texts. (shrink)

Delphine Abadie Malgré une historiographie riche de plusieurs orientations, les imaginaires, la recherche et les débats académiques semblent parfois demeurer enfermés dans l’exigence d’un devoir-être de la philosophie africaine tout à fait caractéristique du seul moment ethnophilosophique. Pourtant, les avenues les plus récentes en philosophie africaine partagent un ensemble de présupposés qui rendent inopérante cette confrontation stérile entre un type de philosophie qui désignerait la « véritable » manière de décoloniser les épistémologies africaines, et toutes les autres formes de (...) la philosophie en Afrique. Depuis les années 1980, on doit constater pourtant que la plupart des philosophes du continent ont emprunté des avenues qui nous éloignent de ce premier moment décolonial de l’« authenticité africaine » en internalisant les critiques développées durant les plusieurs décennies qu’a duré la fameuse querelle de la philosophie africaine. Éclairé par la distinction entre approche décoloniale et approche postcoloniale, cet article propose une relecture des chemins parcourus, des détours et des mutations opérées par la philosophie africaine telle qu’elle s’est développée dans l’espace francophone depuis les années 1940 jusqu’à nos jours. Recollection is central to the epistemology of Plato’sMeno. After all, the character Socrates claims that recollection is the process whereby embodied human souls bind down true opinions (doxai) and acquire knowledge (epistêmê). This paper examines the exchange between Socrates and Meno’s slave to determine (1) what steps on the path to acquiring knowledge are part of the process of recollection and (2) what is required for a subject to count as having recollected something. I argue that the key to answering (...) these questions is to get clear on the kind of process recollection is supposed to be. In particular, I argue that recollection is a process akin to the kind of process Aristotle calls “changes” (kinêseisor incompleteenergeiai). The key feature of such processes is that they aim at an end beyond themselves and are not complete until that end comes about. In the case of recollection, the end is knowledge, but inferior mental states, such as false opinion, puzzlement (aporia), and true opinion can come about because of a process of recollection without making it the case that the subject has recollected anything. I argue that this interpretation provides a textually supported and philosophically coherent understanding of Socrates’ conception of recollection. (shrink)

To test whether mental activities collected from non-REM sleep are influenced by REM sleep, we suppressed REM sleep using clomipramine 50 mg or placebo in the evening, in a double blind cross-over design, in 11 healthy young men. Subjects were awakened every hour and asked about their mental activity. The marked REM-sleep suppression induced by clomipramine did not substantially affect any aspects of dream recall . Since long, complex and bizarre dreams persist even after suppressing REM sleep either partially or (...) totally, it suggests that the generation of mental activity during sleep is independent of sleep stage. Tackling grand challenges requires coordination and sustained effort among multiple organizations and stakeholders. Yet research on stakeholder theory has been conceptually constrained in capturing this complexity: existing accounts tend to focus either on dyadic level firm–stakeholder ties or on stakeholder networks within which the focal organization is embedded. We suggest that addressing grand challenges requires a more generative conceptualization of organizations and their constituents as stakeholder systems. Using the metaphor of ballet and insights from dance theory, we highlight four defining (...) dimensions of stakeholder systems (two structural and two dyadic); we proceed to offer a dynamic model of how those dimensions may interact and coevolve. Our metaphor and resulting theory of stakeholder systems are thereby well equipped to incorporate the complexity of tackling grand challenges, where many contemporary stakeholder arrangements are oriented around issues rather than firms. This essay lays the groundwork for a novel conception of autonomy that may be called “effective autonomy”—a conception designed to be genuinely action guiding in bioethics. As empirical psychology research on the heuristics and biases approach shows, decision making commonly fails to correspond to people’s desires because of the biases arising from bounded cognition. People who are classified as autonomous on contemporary philosophical accounts may fail to be effectively autonomous because their decisions are uncoupled from their autonomous desires. Accordingly, continuing (...) attempts to value patient autonomy must go beyond existing philosophical conceptions of autonomy to consider the background conditions of human decision making. The aim of this study was to investigate the level of specificity of the different regulation types described by Self-Determination Theory, and to evaluate its impact on the links with its antecedents and consequences, in an academic context. In line with the school-subject-specificity hypothesis, we postulated that autonomous motivation types would be more specific to the situational level than controlled motivation types. Moreover, we hypothesized that AM types would be, at this level, more strongly associated with its antecedents and consequences (...) than CM types. Three hundred fourteen university students were asked to complete online questionnaires assessing their motivation, motivational antecedents and consequences in various courses. As expected, results from structural equation modeling confirmed that AM types were more specific to the situational level than CM types. Moreover, a higher number of significant correlations were found between motivation and its antecedents and consequences in the corresponding course for AM than for CM types. Educational implications and directions for future research are discussed. (shrink)

Ce sentiment peut être lié à un défaut d’étayage familial dans l’immédiat post-partum. Cet article présente, à partir d’une recherche universitaire plus large, un cas clinique approfondi dans lequel la distance familiale et géographique a été un facteur de vulnérabilité majeur. Ce cas montre les incidences multiples et intriquées d’un défaut d’étayage familial sur les processus intrapsychiques et intersubjectifs : dépression du post-partum chez (...) la mère qui persiste dans le temps, relations conjugales et parentales qui se dégradent progressivement, et sur les interactions précoces difficiles. Révéler l’existence de ce risque améliorera la compréhension des besoins des parents et des bébés après la naissance et permettrait d’envisager une adaptation plus fine des pratiques professionnelles et des programmes de santé publique et, à plus grande échelle, des politiques familiales. Written in the intense political and intellectual tumult of the early years of the Weimar Republic, _Political Theology_ develops the distinctive theory of sovereignty that made Carl Schmitt one of the most significant and controversial political theorists of the twentieth century. Focusing on the relationships among political leadership, the norms of the legal order, and the state of political emergency, Schmitt argues in _Political Theology_ that legal order ultimately rests upon the decisions of the sovereign. According to Schmitt, only the (...) sovereign can meet the needs of an "exceptional" time and transcend legal order so that order can then be reestablished. Convinced that the state is governed by the ever-present possibility of conflict, Schmitt theorizes that the state exists only to maintain its integrity in order to ensure order and stability. Suggesting that all concepts of modern political thought are secularized theological concepts, Schmitt concludes _Political Theology_ with a critique of liberalism and its attempt to depoliticize political thought by avoiding fundamental political decisions. In this, his most influential work, legal theorist and political philosopher Carl Schmitt argues that liberalism's basis in individual rights cannot provide a reasonable justification for sacrificing oneself for the state. This edition of the 1932 work includes the translator's introduction which highlights Schmitt's intellectual journey through the turbulent period of German history leading to the Hitlerian one-party state. It also includes Leo Strauss's analysis of Schmitt's thesis and a foreword by Tracy B. Strong placing Schmitt's work into contemporary context.

Kant’s philosophy is often treated as a closed system, without reference to how it was written or how Kant arrived at its familiar form, the critique. In fact, the style of the critique seems so artless that readers think of it as an unfortunate by-product—a style of stylelessness. In _Constituting Critique_, Willi Goetschel shows how this apparent gracelessness was deliberately achieved by Kant through a series of writing experiments. By providing an account of the process that culminated in his three (...) _Critiques_, this book offers a new perspective on Kant’s philosophical thought and practice. _Constituting Critique_ traces the stages in Kant’s development to reveal how he redefined philosophy as a critical task. Following the philosopher through the experiments of his early essays, Goetschel demonstrates how Kant tests, challenges, and transforms the philosophical essay in his pursuit of a new self-reflective literary genre. From these experiments, critique emerges as the philosophical form for the critical project of the Enlightenment. The imperatives of its transcendental style, Goetschel contends, not only constitute and inform the critical moment of Kant’s philosophical praxis, but also have an enduring place in post-Kantian philosophy and literature. By situating the _Critiques_ within the context of Kant’s early essays, this work will redirect the attention of Kant scholars to the origins of their form. It will also encourage contemporary critical theorists to reconsider their own practice through an engagement with its source in Kant. (shrink)

This article presents recent developments in the Geneva modular and interactionist approach to discourse organization. The first section analyses the main epistemological, theoretical and methodological properties of the Geneva Model by examining its relationship to data, communicative action, complexity and discourse organization, and then outlines the Geneva Model's modular methodology. The second section of the article focuses on a text extract from a service encounter and applies some aspects of the modular methodology to the analysis of request sequences. The authors (...) argue that requests cannot be reduced to the utterance of single speech acts but are best described as complex discourse practices linking praxeological information, conceptual knowledge and textual competence. Along with Machiavelli, Hobbes is usually regarded as the pre-eminent representative of the ‘power-politics’ school of classical realism. He is frequently quoted for his pessimistic depiction of the state of nature that he so famously described as a brutal and anarchic arena in which each individual seeks his own advantage to the detriment of all other individuals, in a perpetual struggle for power. As reflective of this, political realism is sometimes even named the ‘Hobbesian tradition’. Yet there is reason to (...) question whether the standard characterization of realism as a form of moral scepticism which ‘resists the application of morality to war’ provides an accurate description of Hobbes’s political philosophy. This essay aims at questioning different aspects of narrative and description by means of the model of discourse analysis presented in Roulet & al. . After showing the necessity of a unified approach to the structure of different discourse types and the problem of discourse heterogeneity, the author examines the following problems: the distinction between a relation and a narrative and the different modes of insertion of those two types of discourse in an exchange structure, the hierarchical and argumentative (...) structure of narrative, the distinction between narrative and deliberate discourses, the insertion of dialogues in narrative and the co-construction by the interlocutors of a narrative in dialogue. He then sets up a distinction between different types of descriptions and analyses the hierarchical and argumentative structure of description. Summary Bodin's Colloquium Heptaplomeres is one of the most important clandestine manuscripts of the early modern period. A fascinating dialogue between seven different religions it tackles some of the main debates of the early modern era. It has long in the historiography been recognised as a key text promoting toleration. However, a close reading of the text and a focus on the way in which it used and debated written authorities (from ancient literature to the Scriptures) directs us toward another (...) crucial issue of the period. Indeed, it challenges and questions received authorities by making use of the dialogue form to question each in turn. Each character relies on the likes of Aristotle, Augustine or the Bible to support their views only to see them challenged by the others through the use of counter interpretations or other authorities. This leads to seeing the text as fundamentally embedded in the sceptical arguments developing at the time, as noted by early modern readers who voiced their concerns about the way in which this text led to doubt, rather than about the potential toleration it promoted. The goal of this article is to bring together two methodological approaches to the study of images. The first was developed by Aby Warburg, around his work for the Mnemosyne Atlas. The second was created by researchers establishing the framework for a software entitled Lignes de Temps. I will try to demonstrate that a new methodology in the understanding of images works toward a ‘pedagogy of imagination’. I will also try to show how, from my point of view, this innovative (...) methodology, which redefines the roles of the audience and its relationships to pictures, was already active within the research of Warburg. The spectator-researcher does not need a pre-established hypothesis. He or she can trust his own practice with the images to spark a new string of thoughts. From that potential of imagination and creation, a whole new field of singular and personal images may spring. (shrink)

This article focuses on a project of « predictive medicine » elaborated in the late 1960s by an American dentist, Emanuel Cheraskin. In his views, this new label was meant to name a preventive medicine based on the knowledge of individual pecularities. The analysis of this unknown episode of medical history allows to uncover the prospective dimension of this medicine, and also the ambiguities which are linked to the idea that understanding individual peculiarities could help rethink the preventive approach. Through (...) the study of Cheraskin’s propositions, I want to show that the ambition of providing a new basis to prevention, namely a science of individuals, casts a light on the predictive project. While paying attention to this ambition, rather than to genomic techniques, I hope to open new paths in our understanding of various aspects of contemporary predictive medicine. (shrink)

Among the controversial theological texts which gave rise to institutional opposition to Catholic hierarchy at Port-Royal, the treatise De la foy humaine, dated 20 August 1664 and probably secretly published in Paris, takes an original stance on the distinction between science, faith, and opinion. This was originally developed in Port-Royal Logic two years previously. The contentious argumentation in De la foy humaine, centred on the role of mediation in the construction of a belief, is linked to the series of texts (...) that were created in response to the controversy surrounding Jansen’s Five Propositions. The treatise was a reaction to the Port-Royal nuns being forced to sign a form recognising the heresy of the Jansenist book Augustinus by Hardouin de Péréfixe, the new Archbishop of Paris, or risk excommunication. Contrary to its presentation as an abuse of power, the treatise sought to give rational criticism a place and called for the right to disobey untruthful authority. It makes discerning a fundamental Christian requirement necessary: Arnaud and Nicole consider exercising the human conscience within the Augustian conception of the interior master. The argument does not rest on an anachronistic freedom of conscience but on the possibility for man to reasonably submit, despite the difficulty in rationally submitting. (shrink)

Parmi les différentes conceptualisations dont le phénomène de la guerre a pu faire l'objet, l'oeuvre de Thomas Hobbes et celle de Cari von Clausewitz se sont souvent trouvées rangées, depuis le développement du champ disciplinaire des relations internationales en particulier, parmi des auteurs dits " réalistes " tels que Thucydide ou Machiavel notamment. Or leur pensée respective semble échapper à toutes les formes de catégorisation : ni pur " réalisme ", ni bellicisme, ni pensée de la " raison d'Etat ", (...) d'une part, ni idéalisme, "pacifisme ", ou pensée de la guerre juste, d'autre part, l'oeuvre de Hobbes et celle de Clausewitz occupent une place à part parmi ceux qui, semblablement à eux, ont pris la guerre pour objet de leur réflexion. Malgré les deux siècles et bien d'autres choses qui les séparent, une pensée hétérodoxe de la guerre se fait ainsi écho à travers elles. Hobbes comme Clausewitz s'efforcent en effet d'appréhender la guerre, non point en juristes, tel Hugo Grotius, ni même en spécialistes de l'art de la guerre, comme Machiavel, ou bien encore en moralistes, tel Juste Lipse, mais bel et bien en tant que théoriciens soucieux de saisir la logique présidant aux rapports conflictuels entre les êtres humains, c'est-à-dire à la fois la suite des causes et des effets conduisant à la guerre et l'ensemble des règles commandant le déroulement de cette dernière une fois enclenchée. Le tableau de la guerre qu'offrent par conséquent Hobbes et Clausewitz à leurs lecteurs, bien qu'il puisse paraître sombre ou cynique, n'est pas celui de la déraison ou d'une hybris totalement déchaînée : loin de présenter la guerre comme un phénomène inextricable, chacun s'efforce, à sa façon, de rendre intelligible le phénomène guerrier, d'en mettre à nu les principes et les ressorts à la fois passionnels et rationnels, nécessaires et contingents. "L'ouvrage que nous propose aujourd'hui Mme Delphine Espagno est peut-être la plus belle des invitations qui ait été écrite afin d'inciter le lecteur, citoyen et/ou juriste, à comprendre la pensée du doyen de Bordeaux. Léon Duguit méritait effectivement le présent ouvrage et hommage car le doyen, comme Jean-Jacques Rousseau avant lui, a longtemps été et est encore souvent présenté soit comme un marginal de la pensée juridique, soit est même dédaigné de façon méprisante comme si sa qualité de juriste (...) lui était déniée. Hauriou, nous rappelle l'auteure, ira même ainsi jusqu'à affubler Duguit d'être un "anarchiste de la chaire" ce qui n'avait manifestement pas totalement déplu à ce dernier! Car, ce que rappelle Mme Espagno dès son introduction, c'est bien une nouvelle manière de penser et de réinventer le Droit dans son ensemble que nous invite à accomplir Léon Duguit. Il n'est pas qu'un faiseur de théorie(s) (comme celles du service public, des agents publics ou encore de l'Etat), il est - pour reprendre l'expression de Chenot désormais consacrée - un véritable "faiseur de système dans son sens le plus noble et mélioratif. Duguit assume en effet son rôle de guide et nous a donné à voir une nouvelle façon d'appréhender le Droit non pas tel qu'il est mais tel qu'il devrait être. Un Droit qu'il a comme réinventé en chaussant de nouvelles lunettes tel le spectateur qui verrait en deux dimensions et désormais en découvrirait - grâce à lui - une troisième. Après Léon Duguit, les juristes n'ont ainsi pu feindre de ne concevoir le Droit qu'à l'instar d'un artifice fictif, technique et juridique : le Droit est devenu indissociable de la sociologie. Ce "droit duguiste" nous offre alors grâce à la lumière qu'y dépose avec délicatesse Mme Delphine Espagno la vision renouvelée des relations existantes entre Droit, individu et collégialité ou société. En outre, ce que va construire le doyen de Bordeaux n'est pas - comme on le lit encore souvent - une "simple" théorie du service public mais une théorie réaliste de l'Etat par le service public", Mathieu Touzeil-Divina. In this article the authors reflect on regulations which have been developed to protect research subjects and data in research which uses human subjects. They suggest that regulations related to informed consent and privacy protection are burdensome in research which uses human subjects. They argue that a new category of research risk must be established which informs research subjects of the level of risk that they will be exposed to by participating in the research.

Epistemic trust is an unacknowledged feature of medical knowledge. Claims of medical knowledge made by physicians, patients, and others require epistemic trust. And yet, it would be foolish to define all epistemic trust as epistemically responsible. Accordingly, I use a routine example in medical practice to illustrate how epistemically responsible trust in medicine is trust in epistemically responsible individuals. I go on to illustrate how certain areas of current medical practice of medicine fall short of adequately distinguishing reliable and unreliable (...) processes because of a failure to systematically evaluate health outcomes. I conclude by articulating the devastating obstacles to the consilience assumption, which takes intellectual character as the standard for epistemic responsibility. (shrink)

The Grand Challenges literature brings under its umbrella a wide variety of disjointed phenomena but runs the risk of reinventing the wheel as well as overlooking incremental progress and past work. To avert this, scholars need to (dis)connect (dis)similar issues, build on past research on these issues, and create opportunities for generalizability through theoretical examinations.

Rendant compte des travaux récents dans le champ de l’étude sociales des sciences (Social Studies of Knowledge), de la critique féministe des sciences et des cultural studies, cet article revient sur leurs apports et sur la façon dont ils lisent l’histoire des transformations biomédicales (très) contemporaines, notamment dans les domaines de la reproduction et de la sexualité. Les SSK, en particulier, proposent une lecture complexe et riche des relations humains/techniques et de la façon dont les relations sociales et de genre (...) s’y trouvent engagées. S’interrogeant sur la coïncidence de certaines de ces approches (participant du « tournant descriptif » dans les sciences sociales) avec des transformations économiques et sociales plus vastes (la reconfiguration de soi via les biotechnologies comme promesse individuelle en contexte néolibéral), l’article propose de mettre en évidence ce qu’un renouveau de l’approche historienne pourrait apporter en propre : redonner à voir l’épaisseur des contextes scientifiques et sociaux de production de certaines technologies, dire l’historicité des enjeux sociaux et de genre, produire de nouveaux récits attentifs aux enjeux normatifs, politiques et économiques.
